These Terms and Conditions govern your access to our website and your engagement with the interior design and spatial planning services provided by DANA LYNCH DESIGN LTD ("Company," "we," "our," or "us").
By authorizing design work, signing a design proposal, paying a retainer, or using our client portals, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our interior design services. These terms constitute a legally binding agreement between you and DANA LYNCH DESIGN LTD.
We provide professional interior design, spatial planning, and project management services. This includes but is not limited to: conceptual design, CAD space planning, custom cabinetry design, sourcing of textiles and finishes, and the procurement of custom furniture. The specific scope of work for your project will be defined exclusively by the written Design Agreement executed by both parties.
All design proposals, mood boards, and furniture estimates provided by our studio are valid for 15 days, strictly subject to the current availability and pricing of trade-only vendors. Final project costs may vary due to fluctuations in material pricing, custom upholstery fabric backorders, or unforeseen structural issues discovered during renovations. Any major deviations from the original design plan must be approved through a formal, written change order.
Clients are strictly responsible for funding their design projects according to the milestone payment schedule outlined in their specific contract. Design retainers and 100% upfront deposits on custom furniture and fixtures are required before any orders are placed. We reserve the right to suspend ongoing design work or delay white-glove furniture delivery for any unpaid design fees or procurement balances.
The Client agrees to provide our design team, delivery personnel, and specialized trade contractors with safe, unobstructed access to the property during scheduled working hours. While we may recommend or coordinate with third-party contractors (e.g., painters, electricians), DANA LYNCH DESIGN LTD does not provide general contracting services and is not legally liable for the performance or workmanship of independent contractors hired directly by the Client.
While we strive to adhere to the estimated project timeline, all completion dates are approximate. The Company shall not be held liable for delays caused by factors beyond our reasonable control, including global supply chain disruptions, extended lead times for custom-manufactured furniture, fabric out-of-stocks, or delays in municipal building permit approvals.
We meticulously inspect all procured items upon delivery to our receiving warehouse. However, manufacturer warranties apply directly to all furniture, lighting, and textiles. DANA LYNCH DESIGN LTD provides no independent warranty, express or implied, on manufactured goods. Damage resulting from client misuse, natural fading, or normal wear and tear is expressly excluded from any claims.
You agree to provide accurate architectural floor plans (if requested), to disclose all known structural limitations, and to authorize renovations only if you have legal authority over the site. You are solely responsible for obtaining any necessary approvals from your Homeowners Association (HOA) or architectural review committees prior to the commencement of any installations.
The Company maintains comprehensive professional liability insurance. However, to the fullest extent permitted by law, our aggregate liability arising out of any design project is strictly limited to the total design fees paid to the Company for that specific project. We are explicitly not responsible for indirect, incidental, consequential, or punitive damages, including temporary housing costs during renovations.

These Terms and Conditions and all design contracts shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any legal disputes arising from our design services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state or federal courts located in Fulton County, Georgia.
You agree to fully indemnify and hold harmless DANA LYNCH DESIGN LTD, its officers, principal designers, and staff from any claims, damages, or liabilities arising from your failure to secure necessary HOA approvals or intentional misrepresentation of property boundaries. If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
